INFORMATION NOTICE FOR HEALTHCARE PROFESSIONALS
As data controller, SERVIER BENELUX NV (“SERVIER”), which has its registered office at Internationalelaan 57, 1070 Brussels, processes your personal data mainly on the basis of its legitimate interest to promote its products together with relevant medical information or on the basis of your prior consent when applicable, but also to comply with its legal obligations regarding pharmacovigilance and transparency. In certain cases (e.g. when you visit SERVIER’s business premises), your personal data may also be processed in connection with security management. Moreover, in the event you act as a researcher in the field of clinical research, your personal data will also be processed for the performance of your agreement with SERVIER.
Your personal data will be collected and processed by SERVIER for the following purposes:
- Supervision of medical-scientific cooperation with healthcare professionals (HCPs);
- Managing the delivery of medical information;
- Communication and relationship management and promotional activities (contacts with HCPs) including interactions, management of contractual relationships, conference and meeting management, social media, E-services (e-conferences, etc.);
- Expenditure management in the context of conferences (travel, accommodation, etc.);
- Activities of relationship management with HCPs related to clinical trials and pharmacovigilance activities;
- Transparency management (disclosure of value transfers from SERVIER to healthcare stakeholders);
- Security of visitors and business premises (in case you visit SERVIER’s business premises)
- Management of access to premises and car park
- Management of camera surveillance system to ensure the security of persons and the premises.
Your personal data processed by SERVIER will only be accessible to a limited list of recipients on a need-to-know basis or when required by law.
Thus, the main categories of recipients will be SERVIER’s authorised employees and departments, acting within the scope of their activities, including but not limited to:
- Sales department
- Marketing department
- Department of Medical Services
- Finance department
- Pharmacovigilance department
- International therapeutic research centres aimed at clinical research
- IT department, when necessary.
Other services and individuals might need access to your personal data in connection with specific data processing purposes, such as:
- The Security department and the General Services department for aspects related to the use and security of the business premises (management of access to the business premises and car park);
- The Security department to manage the camera surveillance system.
SERVIER also uses third-party service providers (e.g. hosting services) and business partners (e.g. contractual research organisations (CRO), travel and conference agencies, agencies, hotels, air carriers, etc.) who may also have access to your personal data in order to provide their services. Finally, SERVIER will transfer some of your personal data to competent authorities such as public health authorities.
Your personal data may be transferred to other SERVIER entities and to third party service providers and public health authorities which may be located within or outside the EEA, including countries which do not have the same level of personal data protection as in the EEA, in particular for purposes of hosting and IT support. In such a case, SERVIER ensures that such transfers are carried out in accordance with applicable data protection laws and regulations. Data transfers to other SERVIER entities and data transfers to third-party service providers outside the EEA are secured through appropriate contractual safeguards such as the Standard Contractual Clauses issued by the European Commission. You may request and receive a copy of such documents by contacting us as indicated below.
Your personal data collected by SERVIER will be kept in a format that allows you to be identified no longer than necessary for the purposes for which the personal data are processed. More specifically:
- Personal data for medical-scientific healthcare collaboration and medical information management will be kept for a period of 5 years after your last interaction with SERVIER, then the data will be archived for 5 years and deleted;
- Personal data collected for communication and relationship management and promotional activities (contacts with HCPs) will be kept for a period of 5 years after your last interaction with SERVIER, then the data will be archived for 5 years and deleted;
- Personal data collected for expense management in the context of conferences (travel, accommodation, etc.) will be kept for a period of 5 years after your last interaction with SERVIER, then archived for 10 years and deleted;
- Personal data collected as part of relationship management with HCPs in connection with clinical trials and pharmacovigilance activities will be kept, archived and deleted in accordance with applicable laws and regulations;
- Personal data related to transparency management will be published on the website www.betransparent.be for a period of 3 years and retained by SERVIER for 10 years in accordance with applicable law;
- Images from the camera surveillance system are kept for 30 days;
- Data related to visitor and premises security will be kept for no longer than 3 months.
As a data subject, you have the right to request SERVIER, to the extent permitted by applicable laws and regulations, to access, rectify or erase your personal data at any time. You also have the right to request a restriction on the processing of your personal data or to oppose such a processing in some circumstances. Where data processing is based on your consent or on a contractual relationship with SERVIER, you may also have the right to obtain and transfer to another controller only the personal data that concern you and that you yourself have provided to SERVIER in a structured, commonly used, machine-readable and interoperable format (data portability).
Where your personal data are processed on the basis of your consent, you also have the right to withdraw your consent at any time. The withdrawal of consent does not affect the lawfulness of processing based on the consent before its withdrawal.
Finally, you have the right to lodge a complaint with the Data Protection Authority in relation to compliance with applicable data protection laws and regulations.
